As colocações de sentence - Parte 3

Concluindo os padrões linguísticos que coocorrem com sentence, apresentamos abaixo mais alguns contextos e respectivas traduções.

Em nossas colunas, costumamos dar muita ênfase aos padrões linguísticos formados por determinados termos jurídicos. Nossa opção justifica-se por não serem tais informações, em regra, disponibilizadas em obras de referência.

21. aggregate sentence - "However, the power to impose an aggregate sentence is a useful tool in the armoury of a sentencing court, particularly when imposing a large number of penalties which carry with them the potential for the imposition of a total penalty which is excessive."1 Tradução: pena consolidada

22. consolidated sentence - "Because Lineberger is serving a consolidated sentence, each day that he is incarcerated is service against the unified whole of the sentence, even though based onthree convictions - common law robbery,conspiracy to commit armed robbery, and kidnapping. Because the consolidated sentence is a unified whole, it is not possible or rational to identify one day of incarceration as being service against Lineberger's robbery conviction, the next day as being service against his conspiracy conviction, or the next day as being service against his kidnapping conviction."2 Tradução: pena unificada, pena comum [imposta por diversos crimes]

23. definitive sentence (ver fixed sentence, flat sentence, straight sentence)

25. flat sentence - "A straight or flat sentence is a fixed sentence without a maximum or minimum."3 Tradução: pena [de duração] indeterminada

26. general sentence (ver consolidated sentence)

27. nominal sentence - "For conviction of any felony with one prior strike, the nominal sentence is double the nominal sentence under the previous law."4 Tradução: pena base (ver presumptive sentence)

28. non-custodial sentence - "Lawyer of the gay couple, Steven Monjeza, 26 and Tiwonge Chimbalanga, 20 convicted for homosexuality, has asked the Blantyre Magistrates Court to mete a non-custodial sentence mitigating the two men were first offenders and their crimes did not victimise anybody."5 Tradução: pena não restritiva de liberdade

29. presumptive sentence - "Similarly, in California, the presumptive sentence for rape between 1976 and 1994 was six years in state prison (which could drop to three years due to mitigating circumstances or increase to eight years with aggravating circumstances)."6 Tradução: pena base

30. prior sentence - "In calculating a defendant's criminal history category, § 4A1.1 directs the district court to add three points for each prior sentence of imprisonment exceeding one year and one month, two points for each prior sentence of at least sixty days not counted in subsection (a), and one point for each prior sentence not counted in subsections (a) or (b). § 4A1.1(a)-(c)."7 Tradução: pena anterior

31. split sentence - "In criminal law, a court may be permitted to hand down a split sentence when imposing punishment on a defendant. Typically, this means that, while the defendant is ordered to spend mandatory time in jail, he or she isn't incarcerated for the entire sentence. Rather, the court ordinarily suspends part of the sentence and places the defendant on probation for the remaining time."8 Tradução: pena parcialmente cumprida em regime fechado, pena em regime progressivo
