As colocações de motion no inglês jurídico - Parte 2

Dando seguimento ao tema inaugurado na semana passada, abaixo mais algumas colocações do termo motion (pedido, petição) no inglês jurídico, acompanhadas de exemplos autêntico retirados do COCA - Corpus of Contemporary American English1.

11. motion for judgment n.o.v., motion for judgment notwithstanding the verdict, motion for judgment as a matter of law - "[A]n issue not clearly answered by other courts [was]: what sort of showing, short of direct evidence that a defendant's hazardous waste was disposed of at the site in question, will suffice to allow a CERCLA plaintiff to survive a motion for judgment as a matter of law, and hence survive a summary judgment motion?".

Tradução: pedido de anulação do julgamento pelo júri por incoerência da decisão com a produção de provas.

12. motion for new trial - "And the trial court ruled that the defense wasn't entitled to this and denied their motion for new trial".

Tradução: pedido de novo julgamento.

13. motion for nolle prosequi - "Nolle prosequi motions are those entered by prosecutors indicating that they do not wish to proceed with a case after indictment".

Tradução: pedido de desistência da ação feito pela acusação.

14. motion for summary judgment - "On April 1, 1998, Judge Wright granted President Clinton's motion for summary judgment, concluding that even if the facts alleged by Paula Jones were true, her claims failed as a matter of law. Ms. Jones has filed an appeal, and as of the date of this Referral, the matter remains under consideration by the United States Court of Appeals for the Eighth Circuit".

15. motion in limine - "[T]he district court denied Microsoft's motion in limine to exclude such hearsay statements".

Tradução: pedido de exclusão ou inclusão de provas a serem submetidas ao júri.

16. motion to remand - "Cote explained her goals in a March 2003 opinion denying one plaintiff's motion for a remand to state court: "If this court were to... remand the litigation originally filed in state court, motion practice and discovery would proceed separately in many jurisdictions".

17. motion to vacate the conviction, motion to vacate the order of condemnation - "The court has reviewed the motion and the court grants the motion to vacate the conviction and sends and orders the release of the defendant".
