Quase sinônimos no inglês jurídico: breach & infringement

Como já vimos em diversas oportunidades, o inglês jurídico é repleto de sinônimos.

Normalmente, os sinônimos vêm na forma de binômios¹ redundantes como null and void e will and testament. Nesses casos, a orientação é traduzir o binômio por um único termo, tendo em vista que uma tradução dos três elementos implica redundância e falta de idiomaticidade na língua de chegada.

Assim, a tradução de null and void corresponde a nulo e a de will and testament a testamento.

Entretanto, em alguns contextos jurídicos, termos tratados como sinônimos em muitos contextos podem assumir acepções ligeiramente diferentes. Vejamos o caso de breach e infringement.

Breach & Infringement

Ambos os termos podem ser traduzidos por desrespeito e/ou descumprimento.

Todavia, breach é o desrespeito de obrigação ou cláusula contratual e infringement o desrespeito a direitos, principalmente o desrespeito a direitos de propriedade intelectual.

Breach

.nor shall any waiver of any breach of any provision of this Agreement constitute a waiver of any succeeding breach of such provision or a waiver of such provision itself.

Termination for Breach. Either Party may terminate this Agreement in the event the other Party has materially breached or defaulted in the performance of any of its obligations hereunder, and such default has continued for thirty (30) days after written notice

Infringement

Termination for Infringement. Either party may terminate this Agreement immediately should any Software become, or in either party's opinion be likely to become, the subject of a claim of infringement of any intellectual property right.

Licensee, at its expense, must enforce any patent exclusively licensed hereunder against infringement by third parties and it is entitled to retain recovery from such enforcement.

In any infringement suit or dispute, the parties agree to cooperate fully with each other.

In case of any of the equipment is in any suit held to constitute infringement and its use is enjoined, the Contractor shall, at its option and expense procure for the User Agency the right to continue using the equipment.
