Em continuidade ao tema inaugurado na semana passada, Termos fundamentais em inglês jurídico, na coluna de hoje abordaremos o termo court. Entendemos por termos fundamentais ou elementares, aqueles que, em virtude de sua alta ocorrência no discurso jurídico, são essenciais para que o receptor do referido discurso atinja um nível inicial de compreensão da área de especialidade.

Court, assim como legal pode ser uma palavra cognata (corte) em alguns contextos, mas essa, definitivamente não é a regra. Portanto, a partir do exame de exemplos autênticos em linguagem natural em inglês¹, nos quais o termo court aparece em diversos sintagmas nominais, vejamos algumas de suas possíveis traduções para o português.

court (n.)

1. corte

 Suprema Corte - "[.]he privately suggested to some at the time he was nominated to the Supreme Court."

2. tribunal

 tribunal de justiça - "[.] the [Supreme] Court reversed the judgments of the Ohio Supreme Court, the Ohio Court of Appeals, the trial judge, and the jury [.]"

3. juiz

 juiz - "According to Lopez, they complained about his writing to the court [.]"

4. juízo

 em juízo - "Although the attorney general defends the cases in court, Brunner has hired an outside lawyer to manage the mess [.]"

5. judiciário

 recorrer ao judiciário - "[.] women held their own property and often went to court to defend their rights [.]"

6. instância

 alta instância - "In Roe v. Wade, the highest court in the land declared that the most important document in the land approved of abortion [.]"

 instância inferior - "In fact, it requires a search of the lower court decisions to identify the nature of the gross obscenities the Court protected with the First Amendment."

 instância superior - ver alta instância
