Declaração Pro Bono para as Américas

CONSIDERANDO QUE acesso à justiça é essencial á sociedades democráticas;

CONSIDERANDO QUE nem todos os membros da sociedade têm um acesso significativo às cortes e à representação legal efetiva, e isso sendo especialmente o caso para as pessoas e grupos pobres e desprivilegiados;

CONSIDERANDO QUE governos têm recursos limitados para dedicar às necessidades legais cruciais dos individuais pobres e desprivilegiados muitas vezes deixando as necessidades não atendidas;

CONSIDERANDO QUE a ausência de acesso à justiça debilita a confiança pública em instituições jurídicas e governamentais;

CONSIDERANDO QUE a profissão legal tem um papel privilegiado e está unicamente posicionada em assuntos de justiça e por conseqüência tem a obrigação, os meios, e a oportunidade de promover um justo e eqüitativo sistema legal em colaboração com o Estado e o poder judiciário;

CONSIDERANDO QUE tradições existem nas Américas e novos esforços já estão em andamento em vários países, inclusive colaborações entre Ordens de Advogados, escritórios de advocacia de interesses privados e públicos, faculdades de direito, fundações e organizações não-governamentais, para atender á essas necessidades urgentes e não atendidas;

CONSIDERANDO QUE um movimento coordenado nas Américas para promover acesso à justiça a traves de trabalho pro bono fortaleceria compromissos á democracia e serviço público na profissão jurídica;

CONSIDERANDO QUE as diferenças entre os sistemas jurídicos e as tradições dos países podem ser uma fonte de inspiração para padrões e práticas pro bono inovadoras;

NÓS, os membros da comunidade jurídica das Américas, subscritos abaixo, declaramos solenemente nosso compromisso á pro bono declarando o seguinte:

Os membros da profissão jurídica têm a obrigação de prover serviços jurídicos pro bono. Esta obrigação surge do papel e objectivo da profissão na sociedade, e de seu implícito compromisso á um sistema jurídico justo e eqüitativo.

Pro bono é derivado da frase latina pro bono público, que se refere á atos feitos "pelo bom do público".

Por razões desta Declaração, serviços jurídicos pro bono são esses feitos sem remuneração, ou a esperança de uma remuneração, principalmente para beneficiar pessoas e grupos pobres e desprivilegiados ou as organizações que os ajuda. Isso pode incluir a representação de pessoas ou grupos de pessoas que de outra maneira não poderiam afirmar ou exercitar seus direitos como seres humanos ou obter acesso á justiça. Ademais, serviços legais pro bono também podem beneficiar às instituições cívicas, culturais ou educacionais servindo ao interesse público que de outra maneira não poderiam obter representação.

Serviços legais pro bono devem ser fornecidos com a mesma qualidade de representação fornecida á clientes pagantes.

O fornecimento efetivo de serviços legais pro bono requer cooperação entre os vários atores da profissão jurídica - inclusive Ordens de Advogados, escritórios de advocacia de interesses privados e públicos, faculdades de direito, fundações e organizações não-governamentais.

NÓS, os subscritos abaixo, cada um de acordo com nossos papeis respectivos na profissão jurídica, nos comprometemos á:

Melhorar a representação efetiva para pessoas pobres e desprivilegiados.

Realçar acesso significativo e espalhado ao sistema jurídico á pessoas e grupos que tem falta de tal acesso.

Prover, numa base pro bono, mais de 25 horas ou três dias de serviços jurídicos por cada advogado por ano, ou no caso de escritórios de advocacia ou outras instituições, uma media de mais de 25 horas por cada advogado por ano.

Fortalecer o compromisso da profissão ao fornecimento e o desenvolvimento de serviços jurídicos pro bono por meio de enfatizar sua importância e pratica na educação jurídica.

Apoiar o estabelecimento e o desenvolvimento de organizações não-governamentais dedicadas ao fornecimento de serviços jurídicos que são do interesse público.

Advogar dentro da profissão pelo reconhecimento e promoção de serviços jurídicos pro bono como parte do conceito de ética e as obrigações de um advogado.

Esta Declaração não tem como sua intenção de alterar ou por de lado nenhuma legislação, resolução ou código ético, de qualquer jurisdição já existente que seja mais favorável ao fornecimento de serviços jurídicos pro bono.

-Michael J. Gillespie
Michael Gillespie is Co-Chair of Debevoise & Plimpton's Latin America Group and its Media & Telecommunications Group. Mr. Gillespie handles complex cross-border M&A and financing transactions for clients operating or investing in various sectors, including the media sector. In Latin America, he has been especially active in Brazil, he has worked on numerous M&A, capital markets, and restructuring transactions over nearly two decades. Mr. Gillespie heads up the firm's work for Brazilian media group Globo Organization. Chambers USA (2006) lists Mr. Gillespie as a leader in media and entertainment transactional law.

-Marcello Hallake
Marcello Hallake is a partner in the New York office of Thompson & Knight LLP. He focuses his practice on the representation of U.S. and European companies, financial institutions, and investment funds in cross-border mergers and acquisitions, joint ventures, privatizations, private equity, and other financing transactions in Latin America and around the globe. In addition, he represents Brazilian and other Latin American companies and financial institutions in U.S. and cross-border transactions. Mr. Hallake is the Chair of the Committee on Inter-American Affairs of the Association of the Bar of the City of New York, and is a member of the board of various not-for-profit organizations, including Brazil Foundation, CDI International (Comite pela democratizao da informatica) and the Inter-American Culture and Development Foundation.

-Marun Jazbik
Marun Jazbik is Special Counsel at Sullivan & Cromwell. Mr. Jazbik's practice areas include Mergers & Acquisitions and Securities. Mr. Jazbik received his J.D. and LL.M. from Columbia University School of Law, and graduated from the Universidade do Estado do Rio de Janeiro, Law. Mr. Jazbik is admitted to in New York and Brazil.

-Eric Ordway
Is a leading member of Weil Gotshal & Manges's International Arbitration group with extensive experience in international litigation and arbitration, products liability, mass tort and complex litigation. Mr. Ordway also has extensive experience in antitrust and bankruptcy, having been responsible for the litigation of all claims in one of the largest real estate bankruptcies of the 1990's. In addition, he has supervised internal investigations concerning environmental spills, cosmetic products and pharmaceuticals, and coordinated litigations across the country concerning the same product. Mr. Ordway has handled international arbitrations before various arbitral institutions. He was also consulted with respect to the development of the arbitration provisions of NAFTA and frequently advises clients on the proper drafting of arbitration agreements. He currently serves on the European Advisory Committee of the CPR Institute for Dispute Resolution and is a member of the Club Espagnol D' Arbitrage. He previously served on an ICC Task Force on the arbitration of antitrust disputes and was a former Chairman of the Subcommittee on International Litigation for the Trial Practice Committee of the American Bar Association. Mr. Ordway has written extensively on international arbitration and other forms of alternate dispute resolution, and is a co-author of a chapter on alternate dispute resolution in The Corporate Counselor's Deskbook and a biannual column on international arbitration in the United States in the French law journal Gazette du Palais. Ordway was recognized as a leader in International Arbitration by Chambers Global 2006 and 2007, The World's Leading Lawyers for Business and by Chambers USA 2005 and 2006 America's Leading Lawyers for Business. He was ranked as "Highly Recommended" in the 2004/05 edition of the PLC Global Counsel Dispute Resolution Handbook, and he was recognized in PLC Which Lawyers? Yearbook 2006-2007. Mr. Ordway speaks French and Spanish, and has a good knowledge of Portuguese and Italian.

-Carlos Spinelli-Noseda
Carlos Spinelli-Noseda joined Sullivan & Cromwell in 1994 and became a partner of the Firm in January 2003. Mr. Spinelli-Noseda is actively involved in the Firm's Latin American practice, and has broad and extensive experience representing issuers and underwriters/dealer managers in public and private international offerings of equity and debt securities, including hybrid capital securities, restructurings and in mergers and acquisitions matters. A significant portion of Mr. Spinelli-Noseda's practice involves sovereign issuers, and he is regularly engaged in debt offerings by several Latin American nations as well as the structuring and execution of exchange offers by sovereigns (of which he has done over sixteen to date). Mr. Spinelli-Noseda is recognized as a leading corporate and finance lawyer in Chambers Global: Guide to the World's Leading Lawyers 2007. He is involved with a number of not-for-profit and foreign policy organizations, including the Council on Foreign Relations and the Council of the Americas. Mr. Spinelli-Noseda, who is of Argentine origin, speaks Spanish, French and Italian fluently and is proficient in Portuguese. See below for details of selected transactions.

-Elise Colomer Grimaldi
As Associate Director/Program Associate at the New York City Bar Association's Vance Center for International Justice, Ms. Colomer Grimaldi coordinates region-wide initiatives in the Americas and country-based projects in Argentina, Brazil, Chile, Colombia, Mexico, Peru and the United States. Her responsibilities include managing the Center's Global Project Clearinghouse, Amicus Network, and website. Ms. Colomer also provides direct support to the Global Network for Justice Initiatives project and to the Vance Center's Executive Director in program development, fund-raising and operational management. Prior to this, Ms. Colomer Grimaldi was Director of the City Diplomacy Program at the Glocal Forum, an international think tank based in Rome that espouses peace building and development cooperation at the municipal level. Before joining the Glocal Forum, Ms. Colomer Grimaldi was a Corporate Social Responsibility Officer at the United Nations Office for Project Services (UNOPS), where she managed the public-private partnership program and project portfolio, providing business and partnership services to the United Nations and World Bank Group. Born and raised in Puerto Rico, Ms. Colomer Grimaldi is bi-lingual in English and Spanish. She received her M.S. in International Social Welfare Administration from Columbia University in 1999 and her B.A. in International Affairs and Peace & Justice Studies from Tufts University in 1997.

Paula Samper is a partner with the firm Gómez-Pinzón, Linares, Samper, Suárez, Villamil. Juan Cambiaso is a partner and chairman of the Board of Directors of Marval, O'Farrell & Mairal. He specializes in banking, financial and corporate law. Mr. Cambiaso teaches banking law at the Business Law Master of the San Andrés University and is chairman of the Development Comittee of the Law School of the Torcuato Di Tella University in Buenos Aires. Mr. Cambiaso is a member of Colegio de Abogados de la Ciudad de Buenos Aires, Chairman of the Advisory Board of the Law School of Torcuato Di Tella University, a member of the Board of Colon Theatre Foundation and Compromiso Foundation and a member of the Executive Committee of the Friends of the Buenos Aires Museum of Modern Art. Mr. Cambiaso is also a member of the Advisory Board of Centro de Implementación de Políticas Públicas para la Equidad y el Crecimiento (CIPPEC), ArteBA Foundation, Poder Ciudadano and Atlas Foundation. Mr Cambiaso periodically publishes articles on legal and economic matters in several local and foreign journals and magazines, is a speaker in seminars and congresses and is active in pro bono activities. Mr. Cambiaso received his law degree from the University of Buenos Aires in 1968.

Todd Crider is a Partner at Simpson Thacher & Bartlett where he is a member of the Firm's Corporate Department. He is an active member of The Association of the Bar of the City of New York, where he is Chairman of the Committee for the Cyrus R. Vance Center of International Justice Initiatives and a member of the Inter-American Affairs Committee. Mr. Crider has previously served pro bono as a legal adviser to the Inter-American Commission on Human Rights. He has participated and lectured at pro bono conferences in Buenos Aires, Argentina and Santiago, Chile and has authored many articles. Mr. Crider received his B.A. magna cum laude from Samford University in Birmingham, Alabama, where he was student body president, his License d'histoire from the University of Paris IV, Sorbonne, where he was a Rotary Scholar, and his J.D. from Columbia University School of Law, where he was a member of Journal of Transnational Law and a Harlan Fiske Stone Scholar.

  • Daniel Grunfeld - California, US

Daniel Grunfeld is the President and Chief Executive Officer of Public Counsel. He serves on the Los Angeles Blue Ribbon Committee on Slum Housing, the Los Angeles County Bar Association Judicial Appointment Committee and as Chair of the Equal Access Committee, the Legal Aid Association of California Funding Committee, the African American/Jewish Leadership Connection and on the National Children's Law Network. Mr. Grunfeld was co recipient of the 7th Annual Elyse S. Kline Memorial Award as Bet Tzedek Legal Services Volunteer Attorney of the Year, and was awarded the Wiley W. Manual Award for Pro Bono Legal Services from the State Bar of California. He was also recognized as a Fellow in 1999 by the British American Project. Mr. Grunfeld graduated with honor from Drexel University and Cornell Law School.

  • Guillermo Morales - Chile

Guillermo Morales is a founding partner of Morales, Noguera, Valdivieso & Beso in Santiago, Chile and a Professor of Law in the Graduate Business Law Program at the Universidad de Los Andes School of Law. He has also taught courses at the Universidad de Chile School of Law on Constitutional and Economic Law. Mr. Morales is an Honorary Legal Advisor to the British Embassy in Santiago, Chile, member of the Advisory Board of Fundación Pro Bono, member of the Advisory Board of the University of California School of Law's International Law Program, member of the Executive Committee of the British-Chilean Chamber of Commerce and President of the Finance and Capital Markets Committee. He has written numerous articles on the Chilean financial sector. Mr. Morales attended Universidad de Chile School of Law, the University of Chicago Law School and Harvard University Business School.

  • Claus Werner von Wobeser - Mexico (NOT ATTENDING)

Mr. von Wobeser has been a Postgraduate Professor of Arbitration at the Escuela Libre de Derecho since 1992. He is president of the Arbitration Commission Mexican Chapter I.C.C. since 1987 and a member of the Advisory Committee on Private Commercial Disputes of NAFTA since 1994. Mr. von Wobeser is the Managing Partner of the law firm Von Wobeser and Sierra, Mexico City.

  • Javier de Belaunde - Peru (NOT ATTENDING)

Mr. de Belaunde is a partner at Estudio Echecopar in Lima and a professor of law at Pontifical Catholic University of Peru School of Law, where he has taught since 1972. He has written many books and publications on topics related to civil and constitutional law as well as judicial administration. Mr. de Belaunde has participated as a member of several commissions that have proposed measures to improve the Peruvian judicial system, including CERIAJUS. He is currently a member of a working group developing a bill to amend the Peruvian Civil Code. Mr. de Belaunde is a member of the board of the National Judges Association and has been named an ad-hoc justice at the Inter-American Court of Human Rights.
